In this lawsuit, called Seraphin v. SBC Internet Services, Inc., the plaintiff alleges that the defendants, often doing business together as AT&T, charge an "Early Termination Fee," generally of $200, when customers end their high-speed internet service with them, even when those customers have agreed to pay less than $20 per month for a period of up to two years. Mr. Seraphin claims that this Early Termination Fee will always or virtually always exceed any damages that AT&T has suffered from the early termination of the contract, and hence is illegal and unenforceable. He seeks to represent a class of customers throughout the United States who have been subjected to AT&T's practice of charging these improper fees despite their having agreed to pay no more than $20 per month, and to obtain damages and an order from the court prohibiting AT&T from charging Early Termination Fees.
